Help!!! Lu is here and we will marry in a few days, so I am looking at the uscis site for aos and needed docs. We have her I-94 with K-I stamp. The embassy in Moscow sent her passport with visa and a sealed packett to be surrendered to passport control : imigrations at point of arrival: Atlanta. The packett was surrenderd. Now the I-485 App. asks for the same docs as the K-I petition.  I do not think we made enough copies, as it was stated in embassy notification of interview, that original docs were needed and would be returned. Now we are without the Medical and police reports, as we gave up the originals at interview and they were not returned. we assumed thse docs were in the Packett to be surrendered and sent on to USCIS. Help!!! very confused.  Thanks Joe

JPjr,

If things are the same when I got married, you should not go rushing into the AOS.  Rule if thumb is to wait about a month after marriage so that her marriage cert, SS# and other docs will have had time to percolate into the system.  By then you should have your original docs back.

Besides. before you have the AOS appointment you must apply for it.  After you apply for it, it will take a few months before you will have the appointment.  It is at the appointment that you will need the originals.

Ronin

P.S.  What originals are you missing? Or should I say, what copies are you missing?

Hi Ron, I did not know that you had to have SScard to get married in Shelby county TN, so things have slowed themselves down. A complication has arisen. First certified translator LU used, translated her name "Lyubov" and that is the way I made out the K1 I-29F petition. For her International PP, Police report and Medical records we used a new friend Sasha of Ankor Agency in Cheboksary. Sasha found the error, when he correctly translated Lu's name to Liubov. He said there would be no problem with embassy interview and  there wasn't. Yesterday at SS ofice, the SS computer kicked Lu's app. back because of the spelling diff. The lady tried several times to correct the spelling diff from her end , but it was a no go. She allerted the USCIS through her terminal, and said it would take 4 wks instead of 2. If we went to USCIS office in person and showed our docs, that it may speed things up.  I made infopass app. and we will go to resolve the problem Feb 20. Where we will discuss our doc. problem and see what the IM officer says. There is supposed to be away online to request the originals be returned , but I have not been able to find it, hopefully this will be resolved at the IM app. Thanks  Joe    PS I am not worried, all has gone so well even when circumstances threw a wrench in the ever slowly grinding cogs.

JPjr,

What a mess!  Well don't worry too much.

1)  SS# is not required for AOS.

2)  This is the Link you are looking for:

USCIS:  Request for Return of Original Documents

If you look at the history of the INS, there has always been confusion with how names are handled.  Of course you are not help things any be adding to the confusion.  Still, it is not your doing.

There is perhaps two ways to handle it:

1)  Go see the USCIS and find out what hoops you have to jump through (I would like to hear about it when you are through).

2)  Continue with your AOS petition as is then go thru a name change after she gets her citizenship.

Ronin
